Please carefully read these Terms of Service (referred to as “Agreement” or “Terms”). Your use of WynWave Tech LLC’s services, website, and applications is governed by this Agreement. References to “the Company,” “we,” “us,” or “our” refer to WynWave Tech LLC. By using our services, you agree to be bound by these Terms. If you do not agree, you should not use our services.
The Company reserves the right to update these Terms at any time. The “Last Updated” date above reflects the most recent revisions. Significant changes will be communicated via email or website notifications.
By using WynWave Tech LLC’s products and services, you agree to comply with and be bound by these Terms. Please review this document carefully. If you do not agree with the Terms, you should cease using our services.
The Company provides software applications and simple website development services. Most of our software products are offered with a perpetual license and one year of updates. Some software is available on a subscription basis (SaaS), while others may have terms unique to each application. For details on each application’s specific licensing, refer to the individual product’s terms. After the initial year, customers with perpetual licenses may opt to purchase or subscribe to additional yearly updates.
For services provided by the Company, these general Terms of Service apply unless otherwise specified in a custom, customer-specific service agreement.
You may need to create an account to make purchases or access certain features. You are responsible for maintaining the accuracy of the information provided and ensuring the security of your account.
When you purchase a product from the Company, you are granted a non-transferable license for personal or business use. This license permits installation on up to three devices. Additional installations require an extra license purchase. Specific applications may have unique usage policies. In cases where no individual terms are provided, these general Terms apply.
All purchases include one year of updates and support, with an option to extend by purchasing additional update plans. Updates aim to improve software functionality and security.
You agree to use the Company’s products and services lawfully and to refrain from unauthorized access, malicious content distribution, or other prohibited activities. The Company reserves the right to restrict access for misuse or unlawful activities.
All payments made to the Company are final, except where specified by the Company’s Refund Policy. For subscription renewals or updates, payments must be made before the renewal date to ensure continued access to updates.
The Company’s products are provided “as is” without warranties of any kind. We strive to deliver reliable solutions but do not guarantee uninterrupted or error-free performance, nor that our software will meet all user requirements.
The Company is not liable for damages arising from the inability to use our products, including but not limited to lost profits, data, or business opportunities.
You agree to indemnify and hold the Company, its affiliates, officers, employees, and agents harmless from any claims, damages, or losses arising from your use of our products, your breach of these Terms, or your infringement of third-party rights.
The Company reserves the right to terminate or suspend access to its services for any reason, including breach of these Terms.
These Terms are governed by the laws of the State of Missouri, and disputes will be resolved in the 13th Judicial Circuit of Missouri.
The Company may update these Terms at any time. Continued use of our services after changes are made indicates your acceptance of the new Terms.
If any provision of these Terms is found invalid by a court, the remaining provisions will remain in effect.
Any dispute arising from these Terms will be resolved through binding arbitration as per the American Arbitration Association’s (AAA) rules. This provision limits your rights to bring disputes in court. Arbitration will proceed individually, without class or representative action. The arbitration will be conducted in the 13th Judicial Circuit of the United States District Court for the Western District of Missouri.
